The Moral, Economic, and Legal Case for Black Reparations

Abstract

This project consists of three articles that together provide a moral, economic, and legal framework for reparations for the descendants of persons enslaved in the United States. The first article advances the "unjust enrichment" argument, demonstrating that the United States must return the wealth accumulated through slavery to the descendants of the enslaved. The second article addresses whether a monetary reparations program can avoid the charge that it reinforces capitalism, a system that is taken by some to be inherently racist. The third article makes the constitutional case for affirmative action and reparations, arguing that the Supreme Court's recent rejection of race-based affirmative action ironically supports affirmative action and reparations for the descendants of enslaved persons.
