lnstrumentalization of Law in Ukraine During the Full-Scale Russian Invasion

Abstract

The project examines the instrumentalization of law in Ukraine during the full-scale Russian invasion. Although Ukraine had been evolving from a hybrid regime toward democracy, wartime conditions and the unprecedented concentration of power in the presidency intensified preexisting tendencies to use law as a political tool. Through legal-dogmatic and political analysis, supported by case studies, the research assesses whether selected actions—such as limits on parliamentary transparency, manipulation of local governance, and delayed appointments—were wartime necessities or politically motivated. The study aims to clarify how emergency conditions shape democratic resilience, institutional autonomy, and risks to the rule of law in a transforming state.
